INTRODUCTION
DEFINITIONS OF TERMS USED In these terms, the words or phrases below will have the following meanings.
◦ You, your authorized person who asks us to provide a delivery service, including any employee, agent or subcontractor acting on your behalf.
◦ We, our, us – Day Express Courier.
◦ Consignment – any item or items we carry for you from one address to another, including any packaging.
◦ Dangerous goods – anything you may ask us to deliver that could put the health and safety of other people at risk. This includes (but is not restricted to) explosives, radioactive material, and items requiring specialist treatment or handling during transportation.
◦ Proof of delivery – a signature or company stamp obtained from the consignee acknowledging that the consignment has been received
◦ Contract shall mean any contract entered into between the Courier and the Customer including this agreement.
◦ Merchant shall mean the party with whom the Day Express Courier is contracting, and shall, unless the context indicates otherwise, include a
reference to the owner of the Goods forming the subject matter of the Contract.
◦ Claim means any claim of whatsoever nature.
◦ Register/Registration means create an account on our Website/the action of creating an account on our Website.
◦ Service means all or any of the services provided by Day Express Courier via the Website or via other electronic or other communication from
Rainbow Express Courier, including but not limited to the information services, content and transaction capabilities on the Website and the ability to make a Purchase.
◦ Website means www.dayexpresscourier.com and any auxiliary website supplementary to our main website.
GENERAL TERMS
◦ Day Express Courier will deliver the goods via bi-cycle, motorbike.
◦ Any business undertaken by Day Express Courier is carried out subject to the conditions hereinafter set out, each of which shall be deemed to be incorporated in and to be a condition of any agreement whether written or oral implied between Day Express Courier and a Merchant.
◦ Day Express Courier reserves the right to refuse the carriage or transportation of any documents or goods for any person, firm of company and the carriage of transportation of any class of documents or goods at its absolute discretion.
◦ Any claims brought by a customer against Day Express Courier hereunder in respect of duties and liabilities must be notified to the office of Day Express in writing within seven days(07) of the day when the documents or goods should have reached their destination.
◦ Merchant must provide reasonable access to the location so that the delivery drivers and/or employees are able to safely deliver the goods
◦ Day Express Courier will do its best to ensure the safety of the goods in transit, and during the introduction of the goods into Merchant residence/business.
◦ Day Express Courier will not be responsible for any damages caused after its delivery drivers and/or employees leave Customers residence. Customer must sign a "proof of delivery" sheet to indicate this.
◦ Every problem must be solved by the the spot of the customer.
◦ If parcel are stolen or lost or damaged, Day Express Courier will compensate price of the product.
QUOTATIONS AND CHARGES
  • All quotations by the Bahok Courier shall be provided for on the website prior to payment
  • Quotations, where given, shall be on the basis of immediate acceptance and shall be subject to withdrawal or revision by the Bahok Courier
  • If any changes occur in the rates and other charges applicable to the Goods, quotations and charges shall be subject to revision accordingly with or without notice
DESCRIPTION OF GOODS
  • The Merchant shall provide to the Bahok Courier prior to loading a full documented description of the Goods on the website. All relevant information pertaining to the goods should filled out accurately
  • Merchant must inspect the goods to determine their condition prior to the departure of Bahok Courier LTD employees and must pack the goods in best condition and fragile goods must be wrapped in bubble wrap or any other format that may not be damaged.
DANGEROUS GOODS

No goods, including radioactive materials, which are or may become dangerous, inflammable or noxious, or which by their nature are or may become liable to cause injury or damage to any person, goods or property whatsoever, shall be tendered to the Company without its express consent in writing
